Capital Asset Research Corporation ("Capital Asset") brought suit against Roger Finnegan and Breen Capital Holdings, Inc. The instant appeal is brought by Capital Asset, challenging the district courts award of attorneys fees to Finnegan. Capital Asset makes two primary arguments on appeal: (1) that the district court lacked subject matter jurisdiction to award attorneys fees to Finnegan; and (2) that any such award should have been denied in any event because Finnegans motion for attorneys fees was untimely.
